When you register at Affetic, you provide us with some personal data in order to enable the provision of our service. Affetic values the security of your data, respect for your privacy and transparency with you and, therefore, we dedicate this document to explain how your personal data will be treated by Affetic and what measures we apply to keep them safe. .

First of all, we introduce ourselves, we are Genypso Gestão para Pessoa Ltda, registered with CNPJ 41.449.522/0001-52, headquartered in the State of Espírito Santo, and according to the definition provided by the General Data Protection Law “LGPD” (Federal Law nº 13.709.2018), most of the time we will be responsible for defining what happens to this data and for protecting it.

To facilitate the understanding of this policy, whenever you find the terms “Affetic”, “we” or “our”, we are referring to Genypso Gestão para Pessoa Ltda. and, every time we read “user”, “you”, “your” or “your”, we refer to you, our client or user of our platforms.

What data is collected:

Information we collect from third parties, such as, for example, complements of your registration data (name, affiliation, date of birth, CPF, telephone number, address, among others), score generated by credit agencies, if you are part of a list Politically Exposed Person (PEP) or any alert list (such as OFAC, UNSC and other international lists), among others.

Information that you voluntarily provide, such as through communications with Affetic on social media or in product reviews and reviews.

Copies of documents sent by you as proof of residence or a copy of an identity document, generally used to prove your registration or validate your identity.


How we use your personal data

We use personal data to ensure quality service and a better experience in providing our services. We list below the purposes for which we may use your personal data:

Registration data:

  • To enable the provision of different services available in the applications

  • To ship the products related to our services.

  • To contact you when necessary. This contact can cover several subjects, such as communication about our services, sending materials, general customer service.

It is important to clarify that Affetic uses geolocation technology from other companies, which allows the capture of location data, without you being directly identified, for the purposes mentioned above.

With whom we may share personal data

In order to carry out the activities listed above, whenever necessary, we may share your personal data with other companies in our group, with service providers, partners or regulatory bodies. We never sell personal data. Below is a summary of these possibilities:

Service providers: so that we can provide our services with quality, we rely on the collaboration of several service providers, who process the personal data collected on our behalf and in accordance with our instructions. These service providers act primarily to assist us with anti-fraud analysis, payment intermediation, marketing campaign management, database enrichment and cloud storage.

Advertising companies, sponsors or members of our PcV program (partners in the co-creation of Value) so that we can improve our products, services and solutions offered to our Clients and/or Users of our platforms and programs.

Other Group companies: your personal data may be shared with other Group companies, which operate under the same level of security and privacy - thus including our affiliates, affiliates, subsidiaries, controllers, sellers - so that we can improve our products, services and solutions offered to our Clients and/or Users of our platforms, as well as allowing a unified management of our entire portfolio.

We store your data securely in data centers located in Brazil as well as abroad. In this case of storage abroad, all applicable legal measures are adopted, in accordance with the General Data Protection Law and its future regulations, guaranteeing the protection and privacy of your personal data.

Your personal data will be kept for as long as you are an active user of Affetic. After that period, we may store your personal data for an additional period for auditing purposes to enable compliance with legal or regulatory obligations. We will retain your data for the necessary period, respecting the deadlines established in the applicable legislation.


Cookies and tracking technologies

We may use certain monitoring technologies to collect information about activities performed on our platforms or applications in an automated manner. The information collected through such technologies is used to perform application performance metrics, identify usage problems, capture User behavior in general and collect content impression data.

Cookies: A cookie is a small file added to the User's device to provide a personalized experience when accessing the platform. Cookies help analyze internet traffic and allow us to know when the User has visited a specific website. A cookie does not give access to a computer or reveal information other than the data the user chooses to share with us.


Pixels: pixels are pieces of installed JavaScript code added to our applications, websites or in the body of an email, with the purpose of tracking and collecting information about user activities, allowing the identification of their access patterns, navigation, interest, and optimizing used to optimize content targeting.


Web beacon: web beacon is a technique that allows mapping who is visiting a certain web page, identifying user behavior with different websites or web servers.

Analytics tools: these tools may collect information about how Users visit our digital platforms, applications, or other company software, which pages they visit and when they visit such pages, other sites that have been visited before, among others.


International transfer of personal data

Some of your personal data may be transferred to other countries, for example, when we use cloud computing services for data processing or storage, located outside Brazil. But in these cases, Affetic also observes all the requirements established in current legislation, and adopts the best market practices in order to guarantee the protection and privacy of your personal data.


Your rights as the holder of personal data

Transparency regarding the processing of your personal data is a priority for Affetic. In addition to the information provided in this Privacy Policy, you can also exercise the rights provided for in the General Data Protection Law, including:

  • Correction of incomplete, inaccurate or outdated personal data.

Ao visitar nosso site ou utilizar nossos aplicativos e/ou serviços, o Usuário estará firmando um contrato legal conosco, que consiste dos presentes Termos de uso, e dos nossos termos legais adicionais para a prestação de serviços. Ao utilizar nossos serviços, o usuário outorga sua anuência aos presentes termos. e reconhece que leu a nossa Política de Privacidade. O usuário não poderá utilizar nossos serviços se não estiver de acordo com todos os nossos termos.

Para utilizar os serviços da GYO, há determinadas obrigações e condições que o usuário deverá cumprir. O usuário deverá, entre outras coisas, assegurar sua maioridade legal, residir e utilizar nossos serviços em uma localidade que o permita. Além disto, o usuário deve ser detentor de todos os direitos em ualquer conteúdo que vier a gravar ou publicar ou que a GYO venha a acessar, importar e/ou enviar ao usuário utilizando nossos serviços, garantir que tal conteúdo seja legal e confiável e que tudo o que for feito com esse conteúdo (ou que seja permitido à GYO ou aos Usuários finais fazer) seja igualmente legal.

O usuário deve observar todas as leis aplicáveis. O usuário é responsável por seus atos e pelos atos de qualquer pessoa que acesse sua Conta de usuário ou suas configurações de plataforma de usuário. O usuário deve fazer backups regulares de seu conteúdo. O usuário concorda que a GYO ou suas parceiras poderão enviar mensagens e conteúdo promocional. O usuário poderá facilmente optar por não receber mensagens promocionais, entrando em contato com a GYO. O usuário permite à GYO utilizar seu site para atividades promocionais, bem como para determinar a forma como os serviços serão prestados. ​O usuário concorda que a GYO tem o direito de impor e mudar os planos de preço por seus Serviços. Além disso, a GYO poderá impor restrições dependendo da utilização específica do Serviço pelo Usuário.

Lista de ações não permitidas: Em geral, a GYO espera que seus usuários sejam cordiais e evitem fazer qualquer coisa que possa prejudicar a GYO ou terceiros. Entre outras coisas, o Usuário não poderá copiar materiais da GYO, utilizar qualquer conteúdo de forma ilegal ou prejudicial, utilizar nossos serviços ou conteúdos em qualquer plataforma ou site que não seja de fornecimento da GYO, fazer declarações falsas ou cometer abusos com nossos Serviços, ou ainda violar os direitos de qualquer pessoa ou qualquer lei aplicável. A inobservância a qualquer das presentes disposições poderá forçar a GYO a cancelar a conta do Usuário e a interromper a prestação de qualquer serviço a ele.

O usuário detém todos os direitos de seu conteúdo. Para prestar seus serviços ao Usuário, a GYO gerencia, armazena, faz o backup e copia o conteúdo do Usuário entre servidores.

A GYO detém todos os direitos sobre seus Serviços, conteúdos, dados, tecnologia e recursos. O usuário poderá utilizar os Serviços e o conteúdo da GYO, desde que observe integralmente os presentes termos e que assegure os pagamentos no valor total e em dia. Algumas fontes disponibilizadas ao usuário são licenciadas por terceiros. Lembre-se também de ler os respectivos termos.

A GYO recebe de bom grado quaisquer feedbacks e sugestões. Se o usuário fornecer à GYO qualquer feedback ou sugestão, deve se certificar de sua precisão e legitimidade.

As faturas pelos Serviços pagos da Wix serão disponibilizadas na Conta do usuário.

Para garantir que não haja interrupções no funcionamento do site ao final do período de assinatura, os serviços da GYO serão renovados automaticamente e cobrados ao Usuário em conformidade a intervalos regulares como sua assinatura inicial, salvo se o usuário cancelar sua assinatura ou desabilitar a renovação automática. Alguns serviços poderão não ser renovados automaticamente, por erro ou intencionalmente. O usuário deve se certificar de que sua assinatura foi renovada em tempo hábil.

A GYO oferece uma garantia de 14 dias dos Serviços pagos mensalmente ou anualmente, com garantia de devolução do dinheiro em caso de insatisfação. Essa garantia pode ser prorrogada, nos termos da lei. Leia cuidadosamente os termos de cada serviço antes de adquiri-lo, pois alguns serviços não são reembolsáveis.

Se o você testemunhar ou for vítima de qualquer tipo de conduta dolosa ou comportamento injurioso por qualquer pessoa que utilize os Serviços GYO, deve informar à GYO imediatamente.

A GYO respeita os direitos de propriedade intelectual de terceiros. Se suas obras com direitos autorais reservados tiverem sido utilizadas indevidamente por qualquer usuário da GYO, informe-nos imediatamente e forneça todas as informações necessárias, e nós tomaremos as providências cabíveis, nos termos da Lei. Se recebermos um aviso de violação de direitos autorais em relação ao site ou conteúdo de um usuário, podemos remover ou cancelar a conta.

A GYO não presta garantias em relação a seus serviços, inclusive em termos de qualidade, confiabilidade, segurança, compatibilidade e condições de uso. A GYO poderá monitorar e editar a Plataforma do Usuário e seu conteúdo. Entretanto, não se considera uma “editora” do conteúdo do usuário, não endossa seu conteúdo e não se responsabiliza por qualquer conteúdo utilizado pelo usuário ou por qualquer outra pessoa. O uso dos Serviços GYO ou de qualquer outro serviço representa riscos. O usuário, pelo presente, aceita esses riscos. Alguns de nossos serviços estão ainda em fase BETA e podem conter erros ou causar interrupções.

Sujeita às leis aplicáveis, a GYO não se responsabiliza por qualquer tipo de dano.
